Terms of Service

1. Acceptance of Terms

By creating an account or using the Editiva platform, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you must not use the service. These terms apply to all users, including free tier users, subscribers, and team members added to an existing workspace.

2. Description of Service

Editiva is an AI-assisted editorial pipeline platform. It provides a structured 7-stage workflow for creating written content — including articles, documentation, and long-form works — with AI assistance at each stage. The platform includes knowledge base management, writer voice fingerprinting, human approval gates, export functionality, and centrally managed Azure-hosted AI Gateway integration.

3. User Accounts

You must create an account to use Editiva. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.

  • You must provide accurate information at registration.
  • Each person may hold one workspace owner account. Team seats are separate user accounts within a shared workspace.
  • You must notify us immediately at security@editiva.io if you suspect unauthorized access to your account.

4. Acceptable Use

You agree not to use Editiva to:

  • Create, store, or publish content that is illegal, defamatory, harassing, or violates the rights of others.
  • Generate spam, bulk unsolicited communications, or content designed to deceive recipients about its AI-assisted origin in contexts where disclosure is legally required.
  • Attempt to circumvent rate limits, authentication, multi-tenancy isolation, or any other security measure.
  • Scrape, reverse-engineer, or reproduce the platform's proprietary pipeline architecture, prompt templates, or AI orchestration logic.
  • Use the service in a manner that violates the terms or safety policies governing Editiva's centrally managed AI Gateway deployments.

5. Content Ownership

You retain all intellectual property rights to content you create using Editiva. This includes your work titles, briefs, writing samples, knowledge base documents, and any content you write directly within the platform. Editiva does not claim ownership of your content and does not use it to train AI models.

6. AI-Generated Content

Editiva does not claim ownership of AI-generated content produced through your account. You are responsible for reviewing all AI-generated output before use, publication, or distribution.

You acknowledge that: (a) AI-generated content may contain factual inaccuracies; (b) the legal status of AI-generated content varies by jurisdiction; (c) where disclosure of AI assistance is legally required, that obligation rests with you as the publisher.

6a. EU AI Act — deployer obligations

Editiva is a deployer and downstream provider of third-party general-purpose AI (GPAI) models. We integrate, but do not train, the underlying language models. The EU AI Act becomes fully applicable on 2 August 2026; the obligations below flow through to you as workspace operator.

  • Article 50(2) marker. Editiva attaches a machine-readable AI-generation marker to every CMS publish and every export, configurable per workspace. Set the disclosure mode in Settings › Compliance.
  • Article 50(4) disclosure. AI-generated text intended to inform the public on matters of public interest must be disclosed unless the text underwent human review with editorial responsibility. Editiva supports both paths via the disclosure mode setting.
  • Article 4 AI literacy. Workspace operators must brief their users on the AI-assisted nature of generated content. The acknowledgment inSettings › Compliance records this commitment.
  • Out of scope. Editiva is not a high-risk system under Annex III. Use of this platform for recruitment scoring, education evaluation, or other Annex III-listed purposes falls outside the intended use described in these Terms and is prohibited under Section 4.

6b. Sub-processors

Depending on the model and feature you use, Editiva may forward your prompts and content to one or more of these processors. Their terms govern training-data and retention of the data you submit through them.

  • OpenAI — GPT-family completions.
  • Anthropic — Claude-family completions.
  • Ollama (self-hosted) — local development models, optional.
  • Azure OpenAI / AI Gateway — for enterprise deployments where applicable.
  • Stripe — payment processing only; no content is sent to Stripe.

7. Payment Terms

Paid subscriptions are billed monthly in advance via Stripe. Credits are allocated at the start of each billing cycle and do not roll over to the following month.

  • Upgrades take effect immediately and are prorated for the remainder of the current billing cycle.
  • Downgrades take effect at the end of the current billing cycle. No partial refunds are issued.
  • Cancellation takes effect at the end of the paid period. Your account moves to the Free tier; data is retained for 90 days after cancellation.
  • AI Gateway usage is metered through Editiva credits and centrally configured model pricing.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Editiva and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the platform. This includes, without limitation, loss of profits, loss of data, or losses arising from AI-generated content errors. Our total liability shall not exceed the amount you paid for the service in the three months preceding the claim.

9. Changes to Terms

We may update these terms from time to time. When we do, we will update the “Last updated” date at the top of this page and, for material changes, notify you by email to the address on your account. Continued use of the service after changes take effect constitutes acceptance of the revised terms.
